In the state of Missouri, marijuana is classified as a schedule 1 substance. A Schedule 1 controlled substance means that the substance has high risk of substance abuse but has little to no medicinal value. Most people are not aware that it is also illegal to drive while under the influence of marijuana.
There are four different penalties usually related to marijuana possession:
- Up to 35 grams: Misdemeanor, usually punishable with a $1,000 and up to one year in jail, and/or both
- Between 35 grams and 30 kilograms-felony: Fine up to $5,000, and/or up to 7 years in prison
- Trafficking (selling or moving) between 30-100 kilograms: If you are found with 30-100 kilograms of marijuana, you are guilty of trafficking drugs even if you have not. This is a felony, with a fine of between $5,000-$20,000 and/or between 5-15 years in prison
- Trafficking more than 100 kilograms: Like mentioned previously even if you do not sell marijuana but are found with more than 100 kilograms you are charged with trafficking. This is a felony and punishable with a $5,000-$20,000 fine and/or between 10 years to life in prison.
